WNDR3400v2 upload being slow/low

It happened recently.
And before I give anything more, I got tired of trying to solve it myself, so I had Charter come over. Apparantly it is a packet issue on their end, even though the call center blamed the router. I don't know when it'll be fixed, but yay!

Has it been that way since you had the router or you did upgrade your service?
What's the brand and model of your modem?
Do you have the latest firmware installed on your router?
What's the speed when you directly connect to the modem?
Are there any devices in the background that's using the Internet?
