Intermittent latency issues and packet loss Nighthawk X10 R9000
I'm having packet loss issues with my router. It just expired passed it's manufacturers warranty. For the price of this thing I can't believe in just around 1 year it broke. I haven't had these issue...

When you say " With the router I see the same but when I'm playing games i'm experiencing massive packet loss. " it makes me think the issue is intermittent. Its hard to rule out a modem/line issue if the problem is intermittent and strickly say its router. Its even tough to narrow it further because many things can cause intermittent problems or latency issues.
What version is this latest firmware?
What modem are you using?
When you're gaming, is it over a hardwire connection or wireless?
If its wireless, which radio are you using? 2.4ghz or 5ghz?
Do you have a screen snip of your modem connections page show both the upload and download?
Is its specific games or a couple games? Is it only when you're gaming?
Are you using qos? or any other traffic monitory setting that you're running?
have you tried a factory reset since you've had your gigabit setup?
Or some games require specific settings?
