ISP's are always great about passing the blame or "we don't know". Its part of the docsis spec that the modem side firmware is approved/sent by the ISP. the manufacturer only submits it to the ISP. Sadly, it takes $ to certify firmware before ISP's will push it out to devices so it happens rarely with 3rd party devices.
