    I finally fixed it.

I returned the CM1000 (DOCSIS 3.1) for the ARRIS SB8200 ( DOCSIS 3.1) and I still had the issue.

After a little bit more digging I have been finding the newer DOCSIS 3.1 modems have their own QOS rules and can interfere with gaming routers such as my nighthawk XR500. It's a shame arris and netgear can't provide a way to disable the QOS rules on the modem''s interface.

I disabled the QOS rules completely on the DUMAOS dashboard and just like that my ping spikes were GONE!

I would love to have my qos set up again but hopefully netgear can provide some sort of firmware update to fix this issue because spending $170 on a modem and $250 on a router is  rididcioulus and I am not able to use the QOS on the XR500 now until this gets sorted out. The dumaos was the reason for purchase but at least the spikes are gone.
