Yeah that was the conclusion I was coming to after reading more online regarding 3.0 and 3.1.
And yes I know the difference between a router and modem. There was no drop down tab available for "modems" just routers

I see I wrote router in my initial post. Yes this is all regarding my modem.

Review your cable modem event log to see if there are any warning or critical level events logged when you are having issues.
