I can't help, but only confirm you are not alone. Many months ago, a comcast tech swapped in their modem and I got 100MB upload speeds, them the cm2050V got 20MB. Now the cm2050v is getting around 40MB, exactly the same as you. So, it seems the new, V10, firmware is better, but there is still a reason this modem cannot get the upload speeds it is supposed to. For whatever reason (comcast or netgear) we have not gotten what we paid for. FYI: I am in the Baltimore, MD area.

Still doing the same here in the Seattle area. For me, the new firmware is performing fine except for the upload. I think they have not released a certified boot file.
