is it the NIC thats faulty?
i doubt it as i even swapped the IP addressess on the two NICs and the issue followed the IP 172.16.10.50
I would recommend one of the following options :-
1) Ideally enable flow control on your NICs and on the switch, this will mitigate the issue.
2) Open a case with Netgear and feel free to reference my case 15895782 which is for an identical issue.
Note that not all NICS and switches support flow control......
