Capability of receiving Xfinity 100mbb

Multiple Xfinity speed tests have reflected 30 - 40mbbs on the above Netgear 70 modem. Although I am charged and paying $40/mo.for 100 mbbs, Xfinity tells me that they are transmitting 100 mbbs and that my modem is only capable of receving what the speed tests are showing. Sounds like a cop- out to me; what do you think?

download speeds"Have the ISP check the signal and line quality UP to the modem.
Be sure there are not coax cable line splitters in the between the modem and ISP service box.
Be sure your using good quality RG6 coax cable up to the modem.
