Well a senior tech at seagate gave me the option of replacement, getting the same problem drives again :)
This was the final offer after 5-6 email back and forth.

Unfortunately there is not much you can do short of replacing the drive. I can't say however that will have any effect but we have no options at this point since you are running the latest firmware.
You can get the replaced by either going online through this link and returning drive as guest http://www.seagate.com/www/en-us/suppor ... assistance
or you can call Warranty Support at 1.800.SEAGATE Monday through Friday from 8 AM to 10 PM EST.
