FSM7328S hardware(?)/firmware issue

I just bought this switch on Ebay. I am afraid that the reseller sold my a faulty unit and I would like to get an opinion of some experts here.

Initially the switch is unable to boot properly

Personally I suspect some kind of hardware issue, however I decided to upgrade the switch to the latest firmware.

Afterwards I tried several times to load the "FSM application" but it always gave me the following error

I was unable to get out this aplication load/boot loop so i did a hot reset of the switch ( reset button, no power down). From that moment on I only see uboot loading but the autoboot does not load anymore.

My questions:
-Does the first error point to a hardware faillure?
-Did I brik my switch when i tried to upgrade to the lastest version?

if you are stuck just this information and stop booting then unit is faulty

A question that is still haunting me, was the unit already faulty before I did the upgrade or did I brik the switch with the upgrade?

Probably bad NVRAM , hardware issues.

Usually this happens when NVRAM is fault and during the writing the file it shows symptoms like that.

I had my FSMxx quit with like you had seen with few boot up information
