Been so busy I didn't get a follow up reply, but for the record in case anyone is interested or if the problem hasn't been directly answered. I've run the new FW on the 2 Seagates w CC43 (in parallel with the older FW CC4H, qty 4) for about what SMART is reporting 1020 hrs and migrating my data slowly over as i build confidence with the drives and its working fine. There's not been any errors of any sort. So mixing the 2 FW's don't seem to be an issue on the drive or the device itself.
