resinch a dieing disk or add new disk & resinch?

I just checked the firmware, it is on RAIDiator 5.3.9, and I have downloaded 5.3.10 which I will install shortly, but there seem to be no relevant changes / bug fixes, only enhancements to cater for newer systems.
I don't know about the warranty status of this unit (HD1 was out of warranty). I'll check in a minute (I don't have the serial no until I remove it, NAS shows it in the SMART infos which are blanc as the disk is inactive); I am not sure about SEAGATE response, considering that it is not a "NAS unit.
Should I hot-remove HD3 or it is better to power down NAS first? I can repower NAS afterwards, no resynching to do since there is nothing to resynch...
