Dead GSM7324 after Switch Recovery Tool?!

So given a 5 year warranty time... if this box was manufactured right at the end of 2004 and possibly purchased at the very beginning of 2005 this box is JUST (like 4-6 weeks) out of warranty? Is Netgear lenient on this kind of issue? I'm wondering if they would be more open to RMA since their software has rendered the box into its current condition? Is it worth making another phone call.
if you got 2nd handed then
1. already been out of warranty by the initial owner
2. unless you have purchased from retailer with receipt that you can prove that can be again is the warranty.
