It creates a 6x3TB RAID-5 layer then attempts to expand to use the extra space on the 4TB disks and fails.

Correct. That's why the use of Flex-RAID where you can have multiple volumes or upgrading to ReadyNAS OS 6 which does not have these expansion limitations would be worth considering.
